 ISN’T IT INCREDIBLE Competition - Terms & Conditions

 

  1. These are the competition-specific terms and conditions for the "ISN’T IT INCREDIBLE Competition" ("the Competition").
  2. The promoter of the Competition is Tim Africa (Pty) Ltd (Registration Number: 2024/110206/07), a private company incorporated under the laws of the Republic of South Africa, with its registered office at 8 Bishop Court, Delamore Road, Hillcrest ("the Promoter").
  3. The Competition excludes participation from the Promoter, its advertising and promotional agencies, directors, members, partners, and employees.
  4. The Competition begins at 09h00 on 15 April 2025 and concludes at 23h59 (midnight) on 15 December 2025 (the "Closing Date"). Entries submitted before 15 April 2025 or after the Closing Date will not be considered.
  5. Entrants must ensure their entries are submitted within the stipulated Competition dates. Entries received before 15 April 2025 or after 23h59 on 15 December 2025, irrespective of the reason, will be ineligible.
  6. The Promoter and its affiliates shall not be liable for entries not received, irrespective of the reason for non-receipt.
  7. The Promoter and its affiliates disclaim any liability for technical failures, malfunctions, or disruptions affecting entry into the Competition, including but not limited to telephone networks, computer systems, servers, or providers.
  8. To enter, participants must comment directly on the Competition advertisements or send a direct message (DM) via the social media platform on which the Competition is advertised.
  9. Entries that are incomplete, illegible, misdirected, delayed, corrupted, or otherwise invalid will be disqualified. Proof of entry submission is not accepted as proof of receipt.
  10. Participants may enter multiple times but are eligible to win only one prize during the Competition period.
  11. Prize: Winners will receive an opportunity to participate in a professionally produced podcast to the value of R10 000.00 (ten thousand Rands only). All advertising rights related to the podcast remain exclusively with the Promoter.
  12. Winners will be contacted telephonically within 3 (three) days following the draw date and must verify their details and confirm availability for recording the podcast.
  13. The Promoter will attempt to contact selected winners a maximum of three (3) times over a period of 72 hours. Should contact fail, the prize will be forfeited, and another winner will be selected under the same conditions.
  14. Winners have 72 hours from initial contact to confirm their participation and availability. Failure to confirm will result in prize forfeiture, and another winner will be selected under the same terms.
  15. Prizes are non-transferable, non-exchangeable, and hold no cash alternative.
  16. The Promoter reserves the right to amend, postpone, or terminate the Competition without prior notice. In such circumstances, participants waive any claims against the Promoter.
  17. Neither the Promoter nor its affiliates, directors, employees, or agents will be liable for any loss or damage, direct or indirect, consequential or otherwise, arising from participation in the Competition or from acceptance or use of the prize.
  18. Winners may be required to sign an indemnity. Refusal or failure to sign will result in prize forfeiture.
  19. The Promoter is not responsible for any costs incurred by participants or winners in entering the Competition or claiming the prize.
  20. Information collected during the Competition will solely be used for Competition management and administration, in compliance with applicable legislation.
  21. Participant data will be retained for as long as legally required and in compliance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).
  22. These terms do not unlawfully limit or restrict any rights or obligations of participants or the Promoter under the Consumer Protection Act, 68 of 2008 ("CPA").
  23. By entering, participants acknowledge adherence to the CPA and undertake to assist the Promoter in fulfilling its CPA obligations.
  24. The Promoter’s decisions regarding all Competition matters are final, and no correspondence will be entered into.

1. Agreement to Terms
Welcome to Tim. These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you (“you”) and Tim (“we,” “us,” or “our”), concerning your access to and use of the Tim website as well as any other media form related thereto (collectively, the “Site”).
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.
These Terms incorporate Tim's Privacy Policy [Link to Privacy Policy], Refunds & Returns Policy , and **Shipping Policy** , which are all integral parts of this agreement.
2. Eligibility
The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.
3. User Accounts
You may be required to register an account with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. Tim reserves the right to remove or reclaim a username if we determine it is inappropriate.
4. Products and Purchases
Tim makes every effort to display as accurately as possible the colors, features, and details of the products available on the Site. All products are subject to availability, and we cannot guarantee that items will be in stock. Prices for all products are subject to change.
5. Payment
All payments shall be made in South African Rands (ZAR). Prices displayed on the Site are inclusive of Value-Added Tax (VAT). 
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.
6. Intellectual Property Rights
The Site is Tim's proprietary property. All source code, text, photographs, and graphics on the Site (the “Content”) and the trademarks and logos (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of South Africa.
7. Prohibited Activities
You may not access or use the Site for any purpose other than that for which Tim makes the Site available. Prohibited activities include, but are not limited to:
•    Systematically retrieving data from the Site to create a collection or database without written permission from us.
•    Using the Site for any illegal or unauthorized purpose.
•    Circumventing or interfering with security-related features of the Site.

8. Disclaimer of Warranties
The Site is provided on an as-is and as-available basis. You agree that your use of the Site and our services will be at your sole risk. To the fullest extent permitted by law, Tim disclaims all warranties, express or implied, in connection with the Site and your use thereof.
9. Limitation of Liability
In no event will Tim or our directors or employees be liable to you or any third party for any direct, indirect, consequential, or punitive damages arising from your use of the Site.
10. Indemnification
You agree to defend, indemnify, and hold Tim harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Site or breach of these Terms.
11. Governing Law and Jurisdiction
These Terms and your use of the Site are governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the courts of South Africa to resolve any dispute.

Tim reserves the right, in our sole discretion, to make changes to these Terms and Conditions at any time. We will alert you about any changes by updating the “Last Updated” date.

Refunds & Returns Policy

Tim wants you to be completely satisfied with your purchase. If for any reason you are not happy with your order, we are here to help. This policy outlines the conditions and procedures for returns and refunds, in line with the Consumer Protection Act (CPA) of South Africa.

1. General Return Conditions
To ensure a smooth and hassle-free return process, please ensure your return meets the following conditions:
•    The item must be returned within the specified time frame (see below).
•    The item must be in its original, unused, and unworn condition. It is acceptable to try on apparel, but not to wear it for an extended period.
•    The item must be in its original packaging, with all original tags, labels, and accessories included and intact.
•    You must provide a valid proof of purchase (your order number or confirmation email).
•    The item must not be on our list of non-returnable items.
Tim reserves the right to refuse a return if the item does not meet these conditions.
2. Reasons for Return & Timelines
A. You Changed Your Mind (Unwanted Goods) If you have changed your mind and no longer want the item you purchased, you can return it to Tim for a refund or store credit.
•    Timeframe: You must log your return within 15 days of the date of delivery.
•    Condition: The item must be in a saleable condition, meeting all the General Return Conditions listed above.
•    Return Shipping: The cost of return shipping for unwanted goods will be for your account.
B. Damaged, Defective, or Incorrect Items Tim takes great care in dispatching orders, but mistakes can happen. If your item arrives damaged, is defective, or is not the item you ordered, Tim will make it right.
•    Timeframe for Incorrect or Damaged on Delivery: You must notify us and log your return within 15 days of the date of delivery.
•    Timeframe for Defective Goods: If an item is found to be defective, you can return it within 6 months of the date of delivery. A "defect" is a material imperfection in the manufacture of a product. This does not include damage from normal wear and tear or misuse.
•    Return Shipping: Tim will cover the cost of return shipping for damaged, defective, or incorrect items.
•    Resolution: For these returns, you can choose one of the following options:
o    Replacement: Tim will replace the item with the same item (subject to stock availability).
o    Refund: Tim will process a full refund to your original payment method.
o    Store Credit: Tim will issue you with store credit to the value of the purchase.


3. Non-Returnable Items
For hygiene and safety reasons, the following items cannot be returned:
•    Intimate apparel, underwear, and swimwear.
•    Earrings for pierced ears.
•    Health and beauty products that have been opened or used.
•    Personalized or custom-made items.
•    Gift cards.
4. How to Log a Return
To initiate a return, please follow these simple steps:
1.    Contact Us: Email Tim's customer service team at info@tim.africa with your order number and the reason for the return.
2.    Await Instructions: Our team will review your request and provide you with detailed instructions on how to return the item.
3.    Package Your Return: Please package the item securely in its original packaging to prevent damage during transit.
4.    Ship the Item: Send the package to the address provided. We recommend using a trackable shipping service, as Tim cannot be held responsible for items lost in transit.
5. Refund Processing
Once Tim receives and inspects your returned item, we will notify you of the approval or rejection of your refund.
•    If Approved: Your refund will be processed to your original method of payment. Please allow 5-10 working days for the refund to reflect in your account.
•    Store Credit: If you opted for store credit, it will be loaded onto your account within 2 working days of the return being approved.

Digital Service Nature
Digital services (including strategy, content creation, advertising campaigns, and web development) are intangible and therefore not eligible for return once delivered or activated.

  • Due to the nature of digital marketing services, all fees are non-refundable once work has commenced.

  • Refunds may only be considered in cases of duplicate payments or billing errors.


2. Cancellation

Clients may cancel before project commencement for a refund minus administrative costs.

Once a campaign, design, or development phase has started, no refunds will be issued.

3. Refund Exceptions
Refunds are only applicable in cases of:

Duplicate payments or processing errors; or

Failure by the agency to deliver the agreed scope of work, as verified in the service agreement.

4. Dispute Resolution
Any refund or credit request must be submitted in writing within 7 days of project delivery. The agency will review all cases fairly and respond within 10 business days.

Shipping Policy

Thank you for shopping with Tim. This policy provides details about Tim's shipping methods, costs, and timelines for deliveries within South Africa.
1. Order Processing Time
All orders are processed within 1-2 working days (Monday to Friday, excluding public holidays) after receiving your order confirmation email. You will receive another notification when your order has been dispatched.

2. Shipping Rates & Delivery Estimates
Shipping charges for your order will be calculated and displayed at checkout. All prices are in South African Rands (ZAR).
•    Standard Shipping:
o    A flat rate of R200 applies to all orders below R3000.00
o    Tim offers FREE standard shipping for all orders of R3000 or more.
•    Delivery Timelines:
o    Major Centres (e.g., Johannesburg, Pretoria, Cape Town, Durban): Estimated delivery within 2-4 working days from dispatch.
o    Regional Areas: Estimated delivery within 3-6 working days from dispatch.
Please note that these timelines are estimates provided by our courier partners and are not guaranteed.
3. Order Tracking
Once your order has been dispatched, you will receive an email from Tim which will include a tracking number you can use to check its status. Please allow 24 hours for the tracking information to become available.
If you haven’t received your order within 7 working days of receiving your shipping confirmation email, please contact Tim at info@tim.africa with your name and order number.
4. Important Information
•    Delivery Address: Tim delivers to physical addresses within South Africa. We do not deliver to P.O. Boxes. Please ensure your delivery address is correct, as Tim cannot be held responsible for orders delivered to an incorrect address provided by you.
•    Order Changes & Cancellations: Once an order has been placed and payment confirmed, it is sent to our fulfillment center. Therefore, Tim is unable to make changes to your order or delivery address after it has been confirmed. Please review your order carefully before completing your purchase.
•    Receiving Your Order: Please ensure that someone is available at the delivery address to receive the order.
